Gibbs Constitutional Law Moot 2026 – Terms and Conditions of Sale

1. Application of Terms

1.1 These Terms and Conditions of Participation (“Terms”) apply to registration for, and participation in, the Gibbs Constitutional Law Moot 2026 (“Moot”).

1.2 By registering for, participating in, or otherwise engaging with the Moot, you agree to be bound by these Terms.

1.3 These Terms apply to all participating competitors, team members, coaches, and any other persons involved in the Moot.

1.4 The Gibbs Constitutional Law Moot Organising Team (“Organising Team”) may issue additional rules, guidelines, policies, or directions from time to time. Those materials form part of these Terms.

2. Australian Consumer Law

2.1 Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable law.

2.2 Where applicable, participants may be entitled to certain remedies under the ACL, including where there is a failure to provide services with due care and skill or in accordance with applicable consumer guarantees.

2.3 To the extent permitted by law, the Organising Team limits its liability in accordance with clause 10.

3. Registration and Fees

3.1 All registration fees are stated in Australian dollars and include GST unless otherwise specified.

3.2 Registration fees, if applicable, must be paid by the deadline specified by the Organising Team.

3.3 Registration is subject to availability and acceptance by the Organising Team.

3.4 The Organising Team reserves the right to refuse or cancel registrations where permitted under these Terms.

4. No Refunds Policy

4.1 Subject to clause 2 (Australian Consumer Law), all registration fees are final and non-refundable.

4.2 Without limitation, refunds, transfers, or credits will not be provided for:

(a) a change of mind;

(b) inability of a competitor or team to participate;

(c) withdrawal from the Moot;

(d) illness, personal circumstances, or changes in availability;

(e) travel, accommodation, or scheduling issues; or

(f) dissatisfaction with any aspect of the Moot.

4.3 Participants acknowledge that their rights to refunds are limited to those required under applicable law.

5. Participation and Team Responsibilities

5.1 Teams are responsible for ensuring that all team members comply with these Terms, the Moot Rules, and any directions issued by the Organising Team.

5.2 Teams must prepare submissions and participate in accordance with the requirements and deadlines specified by the Organising Team.

5.3 Each team is responsible for ensuring the accuracy, quality, and originality of its written and oral submissions.

5.4 The Organising Team is not responsible for any failure by a team or competitor to meet deadlines, prepare submissions, or participate in the Moot.

6. Moot Program, Rules and Changes

6.1 The Organising Team reserves the right, at its discretion, to:

(a) amend the Moot Rules, procedures, or competition format;

(b) vary, reschedule, or cancel rounds or other components of the Moot;

(c) alter hearing arrangements, venues, technology platforms, or timings;

(d) appoint or replace judges, assessors, or competition officials; and

(e) amend competition requirements where necessary for the fair and efficient administration of the Moot.

6.2 Moot details may change at any time, including with limited notice.

6.3 Such changes do not entitle participants to any refund, credit, or compensation, except where required by law.

7. Cancellation or Postponement

7.1 The Organising Team may cancel, postpone, modify, or relocate the Moot (in whole or in part) where it considers this necessary or appropriate.

7.2 Where required by law, the Organising Team will provide an appropriate remedy.

7.3 To the maximum extent permitted by law, the Organising Team is not liable for any additional costs, losses, or expenses incurred by participants arising from cancellation, postponement, modification, or relocation of the Moot.

8. Conditions of Participation

8.1 Participants must be registered and eligible to participate in accordance with the Moot Rules.

8.2 The Organising Team may exclude a participant or team from the Moot for:

(a) breach of these Terms or the Moot Rules;

(b) academic misconduct, including plagiarism or improper use of artificial intelligence;

(c) inappropriate, disruptive, or unsportsmanlike conduct;

(d) failure to comply with reasonable directions from the Organising Team; or

(e) conduct that may adversely affect the integrity or reputation of the Moot.

9. Academic Integrity and Use of Artificial Intelligence

9.1 Participants must comply with the Gibbs Constitutional Law Moot Artificial Intelligence Policy and any related guidance issued by the Organising Team.

9.2 Participants remain responsible for all content contained in their written and oral submissions, regardless of whether artificial intelligence tools or other assistance has been used in preparation.

9.3 The use of artificial intelligence does not relieve competitors of their obligation to conduct independent legal research, understand their arguments, and present accurate legal submissions.

9.4 The Organising Team may take appropriate action where submissions contain fabricated authorities, inaccurate legal analysis, or other material inaccuracies.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, the Organising Team excludes all liability for any loss, damage, injury, or expense arising out of or in connection with participation in the Moot.

10.2 Without limitation, the Organising Team is not liable for:

(a) indirect or consequential loss;

(b) loss of opportunity;

(c) loss of income, profits, or goodwill;

(d) travel, accommodation, or related expenses; or

(e) costs incurred in preparing for the Moot.

10.3 Where liability cannot be excluded under law, liability is limited (at the Organising Team’s option) to:

(a) supplying the relevant services again; or

(b) payment of the cost of supplying those services.

11. Force Majeure

11.1 The Organising Team is not liable for any failure or delay in performing its obligations where caused by a Force Majeure Event.

11.2 A Force Majeure Event includes any event beyond the reasonable control of the Organising Team, including:

(a) natural disasters;

(b) pandemics or public health emergencies;

(c) government restrictions or directions;

(d) industrial disputes;

(e) failures of utilities, technology platforms, or venues; or

(f) other circumstances beyond reasonable control.

11.3 In such circumstances, the Organising Team may cancel, postpone, or modify the Moot without liability.

12. Photography and Media

12.1 The Organising Team may photograph, record, or otherwise capture aspects of the Moot.

12.2 By participating in the Moot, participants consent to the use of their image, likeness, voice, and participation in promotional, educational, or archival materials relating to the Moot.

13. Amendments

13.1 The Organising Team may amend these Terms, the Moot Rules, or related policies from time to time.

13.2 Updated Terms will apply from the date they are published or otherwise communicated to participants.

13.3 The Organising Team may amend these Terms where required to comply with applicable law or to ensure the fair administration of the Moot.

14. Governing Law

14.1 These Terms are governed by the laws of the Australian Capital Territory.

14.2 Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of New South Wales.
